ORDER:
Whereas as, Sri Y.Chandra Mohan, Principal,
DIET, Warangal District while functioning as full additional charge of the post
of District Educational Officer, Guntur
District during the period from 31.08.2005
to 27.10.2006 has committed irregularity in assigning the notional seniority in
the cadre of SGT with effect from 22.09.1994 and monetary benefit from
31.03.1997 to Sri Sk.Md. Khasim, former SGT (Urdu Medium), Govt. Urdu
Elementary School, Pulladigunta, Guntur District against the rules and without obtaining
necessary orders from the higher authorities;
2. And whereas, the Commissioner and
Director of School Education, A.P. Hyderabad has framed Article of Charges
against him in the matter, in the reference 1st read above;
3. And whereas, Sri Y.Chandra Mohan,
Principal, DIET, Warangal District has submitted his written statement of
defence in the reference 2nd read above to the Commissioner & Director of
School Education, A.P., Hyderabad;
4. And whereas, after careful examination
of the matter, the Commissioner & Director of School Education, A.P.,
Hyderabad has concluded the proceedings in the reference 3rd read
above, by awarding minor penalty of stoppage of two increments without
cumulative
effect against Sri Y.Chandra Mohan,
Principal, DIET., Warangal District ;
5. And whereas, aggrieved by the above, Dr.
Y.Chandra Mohan, Principal, Govt.DIET., Warangal District has filed an appeal
in the reference 4th read above before the
Government.
6. Government after careful examination of
the matter, observers that Dr. Y.Chandra Mohan, former Principal (DIET), while
functioning as District Educational Officer (FAC), Guntur, has implemented the
order of A.P.A.T., Hyderabad, issued in Judgment, dated 03.01.2005 in OA
No.580/2001. The District Educational Officer should have obtained permission
from the Director of School Education,
A.P., Hyderabad, before implementing the orders. Since the District Educational
Officer (FAC), Guntur has functioned as per the positive directions of
A.P.A.T., Hyderabad no malafides can be attributed to him and Government
decided to take a lenient view and to drop the charge framed against Dr.Y.Chandra
Mohan, Principal, DIET., DEO (FAC), Guntur in the matter and to set aside the punishment
of stoppage of two increments without cumulative effect awarded in the reference
3rd read above, duly warned the incumbent, to be more careful in future.
7. Accordingly, Government hereby drop the
charges framed against Dr. Y.Chandra Mohan, Principal, DIET., DEO (FAC), Guntur
in the matter and set aside the punishment of stoppage of two increments
without cumulative effect awarded by the Commissioner & Director of School Education, A.P.,
Hyderabad in the reference 3rd read above. Dr. Y.Chandra Mohan, Principal,
DIET., Warangal is warned to be more careful in future.
8. The Commissioner & Director of
School Education, A.P., Hyderabad shall take necessary action, accordingly.
