Guntur Municipal Corporation – Closer of 20 feet Width blind road
under L.P.No.1/76 in DNo.29 (P) Koritepadu Village, Guntur –
Disposal of Site on market value
In the reference first read above, the Commissioner, Guntur Municipal
Corporation has stated that, Smt.Vimala Devi and (2) others in their
representation have submitted that, there is a 20 feet width Municipal blind
road in LP.No.1/76 in D No.294 (P) of Koritepadu. Since the road is dead end
road and left for 4 plot owners only. They had requested to close the blind road
sell in their favour. The entire layout under LP.No.1/76 is vacant without any
development though the layout was approved in year 1976. It is also submitted
that the reserved site of LP.No.1/76 measuring to 190 Sq.Yds. has also been sold
to the plot owners on payment of Rs.6,840/- paid in Challan No.14328, dated:
25-01-1984 as per C.R.No.126, dated: 19-05-1986 interims of the orders of the
Director of Town & Country planning in Proceedings Rc.No.24637/75-H4, dated
08-01-66 (approved of layout rules. Thus the entire site is under L.P.No.1/76 is
vested with 4 plot owner except the dead end road measuring to 12.22 Sq.Yds.
2. The Commissioner, Guntur Municipal Corporation, has further stated that,
the 20 feet width blind road measuring to 122.22 Sq. Yds only useful to the 4
plot owners and no public can be used since there is access to the road from
other house owners and hence, it is desirable to dispose the land to the 4 plot
owners on market value as the land is not useful either to Municipal Corporation
or Public purpose. Therefore, he has requested the Government to accord
permission for the disposal of the said land, which is vested with the Municipal
Corporation for the market value to the plot owners.
3. In the reference second read above, the Director of Town & Country
Planning, Hyderabad has submitted that, as per Section 374 (2) of Hyderabad
Municipal Corporation Act, 1955 with the sanction of the Corporation, the
commissioner may permanently close the whole or any part of public street
vested in the Corporation, duly following procedure given. Further as per section
375 of the said Act, a public street permanently closed under Section 374 of the
said Act may be disposed off the same as land vesting the corporation. He has
therefore, requested the Government to direct the Commissioner, Municipal
Corporation Guntur to take action for notification as per section 374(2) for the
closure of the street and to dispose off the same as per the provisions of HMC
Act, 1955.
4. In the reference third read above, the Commissioner & Director of
Municipal Administration, Hyderabad, while endorsing the letter of the Director of
Town & Country Planning, Hyderabad, has requested the Government to direct
the Commissioner, Municipal Corporation Guntur to take action for notification as
per section 374(2) for the closure of the street and to dispose off the same as
per the provisions of Hyderabad Municipal Corporation Act, 1955.
5. Government, after careful examination of the matter, hereby accord
permission to the Commissioner, Municipal Corporation, Guntur for the disposal
of 20 feet width Municipal blind road in LP NO.176 in D.No. 294(P) of Koritepadu,
measuring 122.22 Sq.Yards, under road portion vested with the Municipal
Corporation, for market value to the 4 plot owners as per Section 374(2), for
the closure of the street, as recommended by the Director of town & country
Planning, Hyderabad and the Commissioner & Director of Municipal
Administration, Hyderabad subject to the finalization of prevailing market value
by the Revenue Authorities.
6. The Commissioner, Guntur Municipal Corporation is requested to take
necessary action in the matter accordingly.
